Simplifying licensing of economic activities in the circulation of narcotic drugs, psychotropic substances and precursors

The Cabinet of Ministers of Ukraine adopted Resolution No. 452 of April 15, 2022 setting out amendments to the Licensing Conditions for Plant Cultivation, Included in Table I of the List of Narcotic Drugs, Psychotropic Substances and Precursors, approved by the Cabinet of Ministers of Ukraine, development, production, manufacturing, storage, transportation, acquisition, sale (release), import into the territory of Ukraine, export from the territory of Ukraine, use, destruction of narcotic drugs, psychotropic substances and precursors included in the specified list”(hereinafter – the Resolution).

The Resolution was drafted in connection with the introduction of martial law on the territory of Ukraine due to the military aggression of the Russian Federation against Ukraine to simplify the licensing of economic activities in the circulation of narcotic drugs, psychotropic substances and precursors,

namely:

the applicant for a license, to obtain it conditions of martial law, should submit an application for a license in electronic form to the licensing authority;

the Resolution amended, in particular, the list of documents provided to the State Service of Ukraine on Medicines and Drugs Control for obtaining a license for the circulation of narcotic drugs, psychotropic substances and precursors.

The Resolution provides that economic entities that have received a license in accordance with this Resolution for the right to carry out economic activities in the field of circulation of narcotic drugs, psychotropic substances and precursors under martial law, within 30 calendar days from the day martial law ceased or was lifted must submit documents to the licensing authority in paper form in accordance with paragraph 6 of the Licensing Conditions for Plant Cultivation, Included in Table I of the List of Narcotic Drugs, Psychotropic Substances and Precursors, approved by the Cabinet of Ministers of Ukraine, development, production, manufacturing, storage, transportation, acquisition, sale (release), import into the territory of Ukraine, export from the territory of Ukraine, use, destruction of narcotic drugs, psychotropic substances and precursors included in the specified list, approved by the resolution of the Cabinet of Ministers of Ukraine of April 6, 2016 No. 282 “Some licensing issues for Plant Cultivation, Included in Table I of the List of Narcotic Drugs, Psychotropic Substances and Precursors, approved by the Cabinet of Ministers of Ukraine, development, production, manufacturing, storage, transportation, acquisition, sale (release), import into the territory of Ukraine, export from the territory of Ukraine, use, destruction of narcotic drugs, psychotropic substances and precursors included in the specified list.”

In case of non-submission of the documents specified in the first paragraph, the licensing authority may decide to invalidate the license.
